Abstract

Bawaslu Regulation No. 7 of 2018 on Handling Findings and Reports of Election Violations serves as the legal basis for the investigative process in addressing election and regional head election violations. The aim of this research is to analyze the authority of the Election Supervisory Board (BAWASLU) in overseeing the implementation of Regional Elections (PILKADA) in Indonesia, particularly regarding investigations and law enforcement against violations occurring during the election process. Bawaslu plays a crucial role in maintaining the integrity of PILKADA by supervising each stage of the election to ensure that it is conducted fairly, honestly, and democratically. The method used in this study was normative juridical, analyzing the legislation related to Bawaslu's authority, specifically Law No. 10 of 2016 on Regional Elections. The findings indicated that Bawaslu's authority in overseeing PILKADA is primarily focused on handling administrative violations, such as campaign procedure violations and the use of state facilities. The sanctions imposed by Bawaslu are administrative in nature, including warnings, reprimands, or disqualification of candidates. However, Bawaslu lacks the authority to address criminal violations, such as vote buying, which falls under the jurisdiction of the police and judicial institutions. The conclusion drawn is that while Bawaslu has a significant role in maintaining the quality of PILKADA, its authority is still limited to administrative sanctions. Therefore, there is a need to strengthen Bawaslu's authority and enhance coordination with other law enforcement agencies to improve the effectiveness of law enforcement in regional elections.
